Welcome to Golden Effort! We are pleased to provide you with access to our platform, services, and content. These Terms of Service (“Terms”) govern your use of Golden Effort’s offerings, available via our mobile app (“app”) and website (“website”). Please read these Terms carefully, as they constitute a legal agreement between you and Golden Effort.

These Terms ensure a safe, respectful, and effective learning environment for all users. They clarify your rights and responsibilities as a user and outline our commitment to delivering a valuable educational experience.

By accessing or using Golden Effort, you agree to be bound by these Terms. If any part of these Terms is unacceptable to you, please refrain from using our platform or services.

Our platform is intended for users aged 13 and above. If you are under 13, you may not use Golden Effort unless you have the consent of a parent or guardian. While Golden Effort is primarily designed for tertiary-level students and adult learners, users of all ages are welcome provided they meet this requirement.

2. Acceptance of Terms

By using Golden Effort, you acknowledge that you have read, understood, and agreed to these Terms. If you are under 13, you confirm that you have the legal consent of a parent or guardian.

Your use of Golden Effort is also governed by our Privacy Policy and Question Submission Policy, both of which are incorporated by reference. Please review them to understand how we handle your personal information and user-submitted content.

We may update these Terms from time to time. If changes are made, we will notify you by updating the Terms on our platform. Continued use of Golden Effort after any changes signifies your acceptance of the updated Terms.

3. User Rights and Responsibilities

Access and Use: You agree to use the platform only for lawful purposes and in compliance with all applicable regulations. As a user, you have the right to access and use Golden Effort’s resources — including e-books and interactive learning tools — in line with these Terms. You are responsible for keeping your account credentials confidential and secure.

Content Ownership and Intellectual Property: Golden Effort retains ownership of the platform’s design, functionality, code, user interface, and any original educational materials or creative works developed by Golden Effort.

For content published on Golden Effort by authors, the original creators retain ownership. However, Golden Effort holds rights through publishing agreements, allowing us to manage and distribute the work on the platform and offer it to users under specific access models.

4. Disclaimer and Limitation of Liability

Golden Effort provides the platform on an “as-is” basis. We do not guarantee that the platform will be available at all times or that it will function without error. To the fullest extent permitted by law, Golden Effort disclaims all liability for any damages arising from your use of the platform.

For purchases made through the Apple App Store, Apple is not responsible for the platform or its content. Any claims relating to the app — including product liability claims, failure to meet legal or regulatory requirements, or consumer protection claims — are the responsibility of Golden Effort, not Apple.

5. Community Guidelines

Although we do not currently allow user-generated content, we may introduce community features in the future. When that happens, we will issue guidelines to promote respect and inclusivity among all users.

6. Safeguarding Author Works

We respect the intellectual property of authors and take additional measures to safeguard their work where necessary. To protect purchased content, we apply digital watermarks using data associated with your account (see our Privacy Policy for details on what data is used).

Users are prohibited from:

• Sharing large sections or entire works of protected content with others.
• Taking screenshots or recording videos of protected content.
• Downloading or copying protected content outside the platform’s intended features.
• Attempting to remove, obscure, or alter any watermark applied to purchased content.

Violation of these provisions may result in account suspension or termination.

7. Terms of Use for Book Purchases

7.1 Subscription Tiers

Golden Effort offers a one-time purchase model for book access across three tiers. Each tier is a single payment — not a recurring subscription. The available tiers are:

The price for each tier is listed on the book’s information page within the app. Access begins from the date of purchase and does not automatically renew.

7.2 Payment Methods

The available payment methods depend on the platform from which you access Golden Effort:

• Android: MTN Mobile Money, Vodafone Cash, AirtelTigo Cash, Visa, and MasterCard — processed via Paystack.
• iOS: Payment is processed through Apple’s In-App Purchase system. The payment methods available are those configured in your Apple ID account.

7.3 Book Access Period

You have access to purchased books for the duration of your chosen tier (1, 2, or 3 years from the purchase date), with both online and offline reading options available. Any updates made to a book during your access period are included at no additional charge.

7.4 Cancellation and Refunds

Once you access a purchased book, refunds are generally not available. If technical issues prevent you from accessing content you have purchased, please contact our support team at support@goldeneffort.com.

For purchases made through the Apple App Store, refund requests are handled by Apple in accordance with their standard refund policy.

7.5 Pricing Updates

We reserve the right to update pricing for future book purchases. Any price changes will not affect previously purchased access periods, and users will be notified in advance of any updates.

7.6 Apple App Store Additional Terms

If you download or purchase access through the Apple App Store, you acknowledge that: (a) these Terms are between you and Golden Effort, not Apple; (b) Apple has no obligation to provide any maintenance or support for the app; and (c) Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

8. Privacy Policy

Your use of Golden Effort is governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the platform, you agree to the terms of our Privacy Policy.

9. Termination and Suspension

9.1 Termination by User: You may terminate your account at any time by following the instructions provided in the app or by contacting customer support. Please note that refunds are not available for completed purchases.

9.2 Termination by Platform: Golden Effort reserves the right to terminate your account for violation of these Terms, fraudulent activity, or legal or regulatory reasons.

9.3 Suspension: Your account may be temporarily suspended for investigations into potential violations or for technical issues requiring maintenance.

9.4 Consequences of Termination or Suspension: If your account is terminated or suspended, access to purchased books may be restricted for the duration of the suspension or termination. Where a suspension is lifted following a successful appeal, access will be restored.

9.5 Notice: We will attempt to provide reasonable notice of account termination or suspension, except in cases where immediate action is required.

9.6 Appeal: If you believe your account was terminated or suspended in error, you may contact our support team at support@goldeneffort.com to appeal the decision.

10. Updates and Modifications

We may update these Terms from time to time. When updates occur:

• Minor updates: We may make minor changes or clarifications at any time without specific notification. These are not expected to materially affect your rights or obligations.
• Significant updates: If we make significant changes that impact your rights or obligations, we will provide reasonable notice before the changes take effect — via a banner on our website, an email notification, or a message within the app.
• Your consent: By continuing to use the platform after changes take effect, you agree to be bound by the revised Terms. If you do not agree, you may discontinue using the platform.

11. Dispute Resolution

11.1 Good Faith Efforts: Both parties agree to make good faith efforts to resolve any disputes through negotiation or mediation before pursuing legal action.

11.2 Confidentiality: All information disclosed during negotiations or mediation will remain confidential.

11.3 Mediation: If a resolution cannot be reached through negotiation, either party may request mediation by a neutral and qualified third party. The costs of mediation will be shared equally by both parties.

11.4 Legal Action: If mediation fails, legal action may be pursued under the laws of Ghana.

11.5 Governing Law: These Terms are governed by the laws of Ghana. Golden Effort will not require users to resolve disputes in any forum or jurisdiction that would be unreasonably inconvenient or unfair to them.
